Position Title: Legal Expert to Draft Bylaws of the Law on Sustainable Investments (“Legal Expert”)

Position Level: Senior

DT Global has been awarded the 5-year USAID-funded Investment Promotion and Access to Finance Activity (“Activity”) in Kosovo. The Activity aims to strengthen the private sector’s capacity to deliver sustainable economic growth through two mutually re-enforcing objectives: 1) investment promotion and attraction; and 2) increased access to and utilization of diversified finance. By achieving these two objectives, the Activity will strengthen the resiliency of the private sector, create productive jobs, increase exports, and enable firms to adopt new technologies and business practices.

Assignment Objective

The Government of Kosovo (GOK) has drafted the new Law on Sustainable Investments (LSI) which envisages the establishment of a new Investment and Export Agency (IEA). The LSI was adopted by the Kosovo Parliament in October 2023. The Activity intends to support the Office of Prime Minister (OPM) to develop relevant sub-legal acts (bylaws) that are relevant for the functionalization of the IEA, as well as relevant bylaws that relate to investment promotion and attraction.

Position Summary

The Activity is seeking a Short-Term Legal Expert (“Legal Expert”) to support the OPM with the drafting of relevant bylaws of the new Law on Sustainable Investments. The Legal Expert will draft the bylaws in close coordination with the OPM’s Legal Office and other relevant GOK and other stakeholders. The Legal Expert will draft the bylaws pursuant to the applicable legislation in Kosovo including the Administrative Instruction no. 03/2013 on Standards for the Drafting of Normative Acts and being guided by international best practices and other relevant considerations.

The planned list of bylaws to be drafted by the Legal Expert include:

  1. Regulation on the Internal Organization and Systematization of Jobs of the IEA.
  2. Administrative Instruction on the Manner of Keeping the Register and Announcements.
  3. Administrative Instruction on Circumstances and Causes, Required Data and Documents,
    and the Manner of Screening.

Based on further consultations with OPM, the Legal Expert may be asked to develop additional by laws, as necessary. Such will be agreed with OPM and the Activity.

SpecificTasks and Responsibilities

The specific tasks of the Legal Expert include:

  1. Draft 3 sublegal acts of the Law on Sustainable Investments1.
  2. Ensure that the drafted bylaws align with other existing laws/bylaws of Kosovo.
  3. Review best legal practices the underpin the operations of similar investment promotion agencies.
  4. To the extent possible and as per Activity and USAID guidance, ensure that the drafted bylaws consider Gender Equality and Social Inclusion (GESI) standards, as applicable.
  5. Draft the bylaws and address any comments from OPM and other stakeholders, including from USAID and the Activity.
  6. Present the bylaws to GOK.
  7. Validate the bylaws with external stakeholders.
  8. Finalize the bylaws based on received feedback.

Minimum Education Requirements
  • Minimum education: bachelor’s degree in law.
  • Preferred education: master’ degree in law.
Minimum Professional Experience
  • Demonstrable experience in a relevant field.
  • Experience working with or supporting the public and private sectors.
  • Capacity for strategic engagement and generating stakeholder buy-in.
  • Excellent written and oral communications skills required.

  • Fluency in English and Albanian required; knowledge of Serbian desirable.
Expected Period of PerformanceNovember 2023 – January 2024.The consultant will provide a detailed work plan with specific milestones and deadlines upon project commencement.
RemunerationThe Expert will be remunerated based on the achievement of the key deliverables outlined above.
Financial proposalShortlisted candidates will be invited to submit a financial proposal to deliver the noted
deliverables/bylaws.
