Commercial Litigation Specialist

(Temporary maternity leave replacement)

Full time

Dexis Consulting Group, implementer for the USAID-funded Kosovo Commercial Justice Activity (Program), is seeking a professional to serve as Commercial Litigation Specialist of the Program. The Program is a multi-year initiative to reduce opportunities for corruption and encourage investment in Kosovo by helping to improve the resolution of commercial disputes and enforcement of judgements.

The Program is organized into two Objective Areas. Objective 1 addresses resolution of commercial disputes in the courts and enforcement. This includes reform of court-based commercial litigation, training of judges and court staff, strengthening oversight and professionalism of the private enforcement agent profession, and improving the trust of businesses towards commercial justice institutions. Under Objective 2, the Program works to increase the use of alternative dispute resolution, ensure that commercial laws are in accord with European Union and international best practices, and improve public awareness of commercial dispute and enforcement mechanisms.

Note: The position is a temporary maternity leave replacement. The assignment is expected to last for about 6 to 8 months with a planned start date in October/November 2024.

Responsibilities of the Commercial Litigation Specialist

The Commercial Litigation Specialist will work closely with Program team members in designing and implementing activities to improve commercial litigation in the courts including:

  • Supporting and proactively contributing to the development and implementation of Program’s Workplan.
  • Collaborating with judiciary officials, legal professionals, government bodies and other stakeholders to foster a supportive environment for the Program’s activities.
  • Support the team in developing, promoting, and implementing reforms of the commercial litigation system in Kosovo, through drafting and advocacy to support legislative, regulatory, policy, and procedure changes.
  • Contributing to the formulation and enhancement of policies and other documents (e.g., guidelines, sublegal acts, manuals) that facilitate the smooth operation of the commercial court and promote a fair and transparent business environment.
  • Supporting the activities of the Program that foster the capacity building and specialization of the judges, legal support, and other staff.
  • Supporting the Kosovo Judicial Council and Commercial Court on activities for improving resolution of commercial disputes in court.
  • Proactively maintaining awareness of developments outside the Program that are related to the Commercial Court and/or private enforcement, as well as to the Program in general, and ensuring supervisor is regularly advised of developments.
  • Preparing reports documenting progress, challenges, and recommendations, and communicating findings to project stakeholders and leadership.
  • Collaborate with other team members in cross-cutting activities and other correlated activities.
  • Supporting the Component 1 team in other Program’s activities.
  • Other tasks and duties as assigned by Objective 1 Leader and COP.

Qualifications and Experience:

  • University degree in a relevant field, degree in law preferred;
  • Excellent command of Albanian and English (written and spoken),
  • Excellent analytical, writing, and communication skills;
  • Excellent command of Word, Excel, and PowerPoint;
  • Professional knowledge and experience in commercial litigation, preferably in the democracy and governance sector;
  • Proven track record working effectively with other projects, high-level Kosovo government counterparts, and other international partners.
  • Driver’s license.

The Commercial Litigation Specialist will report to the Component 1 Leader.
