Legal expertise to support the Ministry of Environment and Spatial Planning to draft and finalize the new Spatial Planning and Construction Legislation Frameworks and the Law on Integrated Waste Management

The GIZ Office in Kosovo is launching the tender for “Legal expertise to support the Ministry of Environment and Spatial Planning to draft and finalize the new Spatial Planning and Construction Legislation Frameworks, and the Law on Integrated Waste Management.” The objective of this tender is to procure legal expert services to support MESP in finalizing these ongoing legislative processes.
MESP has initiated a comprehensive review and revision of Kosovo’s legislative framework in the fields of spatial planning, construction, and waste management, with the objective of improving the effectiveness, implementation, enforcement, and practical impact of these frameworks on the built environment and related public systems. Although the existing legislation in these sectors remains relevant, persistent implementation challenges continue to affect their performance, including weak inter-institutional coordination, limited municipal capacities, insufficient enforcement mechanisms, and a lack of overall operational coherence. These challenges do not affect each sector in isolation, but cut across the broader regulatory and institutional framework, including environmental protection, land management, infrastructure, governance, and other related policy areas.
With support from GIZ Kosovo, MESP is conducting a (1) Spatial Planning Legal Framework Assessment (SPLFA) to generate objective, evidence-based recommendations for legislative reform and to inform the drafting of the (2) new Law on Spatial Planning (LSP) and its related (3) administrative instructions. In parallel, GIZ is supporting MESP in the revision of the (4) Spatial Planning Technical Norms (SPTN), the drafting and finalisation of the (5) new Legal Framework on Construction, and the finalisation of the (6) Law on Integrated Waste Management. Given their interrelated legal, institutional, and technical dimensions, these processes must be developed in close coordination to ensure consistency, mutual reinforcement, and alignment across the broader legislative reform framework.
The tenderer shall demonstrate the capacity to deliver comprehensive, evidence-based draft laws, administrative instructions, and related legal instruments that clearly define Kosovo’s spatial planning, construction, and waste management framework, including the relevant systems, instruments, procedures, standards, and institutional responsibilities. In close coordination with MESP and GIZ, the tenderer shall also design and facilitate an inclusive and participatory drafting process through consultations and working group sessions in order to ensure stakeholder ownership and prepare the legislative package for public review and onward approval procedures.
Planned period of assignment: July 2026 – July 2028

2. Submit the completed and signed Self-Declaration form together with the supporting documents specified below:
- Legal entity registered in Kosovo - Central registry statement with actual data
- Evidence of an average annual turnover of 67,000 EUR (2023, 2024,2025) - Final financial statement 2023, 2024, 2025.
- Evidence of an average number of at least two employees during the past three years Final financial statement 2023, 2024, 2025.
- At least 2 reference project(s) in the field of legal services.
- At least two reference projects implemented in Kosovo within the last three years.
- Only reference projects with a minimum contract value of EUR 15,000 will be considered for the technical assessment.
If we receive more than (e.g.) 5 requests to participate, we will make a selection on the basis of the criteria laid out below and invite only from the 5 tenderers with the highest scores. We reserve the right to cancel the contract award procedure if we receive fewer than three requests to participate.
Your expressions of interest will be ranked by technical experience as weighting in below, the maximum number of candidates is 5:
Provision of Legal Services – 50%
Experience in Delivering Training and Workshops on Public Procedures - 30% Consultation and Facilitation Services - 20%

Important Notes
- The eligibility assessment will be conducted exclusively on the basis of the submitted Self Declaration of Eligibility form and the required supporting documentation.
- Only candidates meeting the eligibility requirements will be shortlisted and invited to participate in the next stage of the procurement procedure.
- Candidates who are not contacted should consider their application unsuccessful.
- All correspondence with GIZ shall be conducted in English or German.
In case of a consortium: - The eligibility requirements may be fulfilled jointly by the consortium members (i.e. it is not required that each member individually meets all eligibility criteria).
- The consortium must clearly designate one member as Lead Partner, who will act as the single point of contact and be authorised to represent the consortium.
- A signed consortium agreement (or letter of intent signed by all consortium members) indicating the Lead Partner and the internal division of responsibilities must be submitted together with the application.
- In the case of bidding consortia and sub-contractors, Self-Declaration of Eligibility form must be completed for each sub-contractor or each member of a candidate/bidding consortium.
